These Terms of Service ("Terms") govern your access to and use of GenBitz ("we," "us," or "our") website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Legal Entity and Governing Law
GenBitz operates under the laws of the State of Delaware, United States. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
2. Description of Service
GenBitz provides AI-powered content generation tools including, but not limited to:
- Nickname, password, and ID generators
- Profile picture, emblem, and banner generators
- Slogan and team name generators
- Account set generators
3. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.
4. Usage Limits and Fair Use

Usage limits are tracked per device using browser fingerprinting technology.
5. Prohibited Conduct
You agree NOT to:
- Use automated systems, bots, or scripts to access the Service
- Attempt to circumvent usage limits or security measures
- Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Use the Service to generate content that infringes on intellectual property rights
- Resell or commercially redistribute generated content without proper authorization
- Interfere with or disrupt the Service or servers
- Reverse engineer or decompile any part of the Service
6. Intellectual Property Rights
6.1 Your Content
You retain ownership of any content you generate using the Service. By using the Service, you grant us a non-exclusive, royalty-free license to process your inputs solely for the purpose of providing the Service.
6.2 Our Content
The Service, including its design, code, graphics, logos, and trademarks, is owned by GenBitz and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
7. Payment and Subscription
- Pricing: Premium subscriptions are priced as displayed at the time of purchase
- Payment Processing: All payments are securely processed by Stripe
- Refunds: Premium purchases are generally non-refundable. Subscription benefits begin immediately upon payment
- Cancellation: You may cancel your subscription at any time. Access continues until the end of the billing period
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GENBITZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless GenBitz and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Dispute Resolution and Arbitration
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, United States. You agree to waive any right to a jury trial or to participate in a class action.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GenBitz regarding the Service and supersede all prior agreements and understandings.
